When using this website (www.kmcchain.eu), including submitting any form via this website, KMC CHAIN EUROPE N.V. (hereafter referred to as KMC), represented by its managing director Christ Bakker, Businesspark Friesland West 33, 8447 SL Heerenveen, The Netherlands, telephone: +31 513 65 06 90, e-mail: Contact form, collects personal data of the users of this website (hereafter referred to as Users).

KMC is the controller of this personal data pursuant to Art. 4 (7) of the EU General Data Protection Regulation (GDPR).

KMC is responsible for the management of personal data of the User and informs him/her that this data will be treated in accordance with the European Union’s General Data Protection Regulation (GDPR) 2016/679 of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, for which the following processing information is provided:

The personal data of the User will be processed for the following purposes:

  • To display this website to the User and to ensure stability and security.
  • To perform services.
  • To conduct statistical studies.

For example, in the form of:

  • Collection of the personal data that the User’s browser transmits to the server of KMC (i.e. IP address, date and time of the enquiry, time zone difference to Greenwich Mean Time (GMT), content of the request (specific page), access status/HTTP status code, amount of data transferred in each case, website from which the request originates, operating system and its interface, language and version of the browser software).
  • Sending of commercial advertising communications, including our newsletter, by email, fax, SMS, MMS, social networks or any other electronic or physical means, present or future, that enables commercial communications. These communications will be made by KMC and related to our products and services, or to our collaborators or suppliers with whom we have reached a promotion agreement.
  • Processing requests or any type of request that is made by the User through any of the contact forms and/or other contact means that are made available to them.

The personal data KMC processes is only used for the above purposes and KMC does not process more personal data than necessary.

Data retention criteria
KMC will not retain the User’s personal data for longer than necessary for the purposes set out in this privacy policy.

Where the basis for processing the personal data is consent, KMC will retain the User’s personal data until it withdraws its consent.

The collected personal data when visiting the website is stored for a period of fourteen days and then deleted.

The grounds on which KMC processes personal data are:

  • Consent, which the User can always withdraw.
  • Legal Obligation.
  • Legitimate interest, i.e. submission of contact forms (regarding warranty).

1. ELECTRONIC CONTACT / COMPULSORY OR OPTIONAL INFORMATION FIELDS PROVIDED BY THE USER

If the User contacts KMC, a contact form is available on the website, which the user can use to contact KMC electronically. The data entered in the input mask will be transmitted to KMC and stored. These data are e-mail address, title, first name, surname, company and telephone number.

The following data is also stored when the message is sent:

(1) The IP address of the User

(2) Date and time of contact.

It is also possible to contact KMC via the e-mail address provided. In this case, the User's personal data transmitted with the e-mail will be stored.

The User’s data will not be passed on to third parties in this context; the data will only be used to process the communication.

The User’s data will be deleted as soon as it is no longer required to fulfil the purpose for which it was collected. For the personal data from the input mask of the contact form and those sent by e-mail, this is the case when the respective conversation with the User has ended. The conversation ends when it can be inferred from the circumstances that the matter in question has been conclusively clarified.

Users, by marking the corresponding boxes and entering data in the fields, marked with an asterisk in the contact form or presented in download forms, expressly and freely and unequivocally accept that the processing of personal data is necessary to meet the User’s request, by the provider, being voluntary the inclusion of data in the remaining fields. The User guarantees that the personal data provided to KMC is true and is responsible for communicating any modification thereof.

KMC expressly informs and guarantees the Users that their personal data will only be transferred with their express consent to the Group companies and authorized Distributors in order to attend to any news, incidents or warranty of the products they sell. All data requested through the website is mandatory, as they are necessary for the provision of an optimal service to the User. In case all data is not provided, it is not guaranteed that the information and services provided will be completely adjusted to the User’s needs.

2. PERSONAL DATA AND THIRD PARTIES

The User’s personal data will not be disclosed by KMC to third parties unless:

  •  This transfer is necessary for the provision of KMC’s services.
  • This transfer is made to a processor, with which processor KMC has concluded an agreement which ensures that the processor offers sufficient guarantees for the protection of these personal data.
  •  KMC is obliged on the basis of a statutory provision to pass on personal data.
  • A court order requires KMC to disclose this data to a third party.

KMC has engaged third parties for the ticketing system that controls the processing of any submitted contact forms through the website. 

3. COOKIES

KMC does not use any marketing or tracking cookies on its website.

KMC placed various social media buttons on its website that link to Facebook, Instagram and YouTube. The User can use these buttons for information about and from KMC, as well as promotion from KMC. KMC is not responsible for the privacy policy of these social media platforms, as these platforms determine how its social media button functions. By using this social media button, a "social media cookie" is placed by the said social media platform so that it recognizes the User.

The privacy policies of these platforms change regularly. The User can read the privacy policies on the website of the specific social media platform.

4. USE OF VIMEO PLUGINS

That in accordance with the provisions in the regulations in force on KMC uses the provider Vimeo for the integration of videos. Vimeo is operated by Vimeo, LLC, headquartered at 555 West 18th Street, New York, New York 10011, USA.

KMC uses plugins from the provider Vimeo on the website. When the User accesses a website on the website that has such a plugin – for example, KMC’s media center – a connection to the Vimeo servers is established and the plugin is displayed. This tells the Vimeo server which of KMC’s websites you have visited. If the User is logged in to Vimeo as a member, Vimeo assigns this information to the personal user account. When you use the plugin, e.g. by clicking the start button of a video, this information is also assigned to your user account. You can prevent this assignment by logging out of your Vimeo user account before using our website and deleting the corresponding cookies from Vimeo.

5. SECURITY MEASURES

That in accordance with the provisions in the regulations in force on personal data protection, KMC is complying with all the provisions of the GDPR regulations for the treatment of personal data of its responsibility, and manifestly with the principles described in article 5 of the GDPR, for which they are treated in a lawful, loyal and transparent manner in relation to the interested party and adequate, pertinent and limited to what is necessary in relation to the purposes for which they are treated.

KMC guarantees that it has implemented appropriate technical and organizational policies to apply the security measures established by the GDPR in order to protect the rights and freedoms of Users and has communicated the appropriate information so that said Users can exercise them.

6. RIGHTS THAT ASSIST THE USER:

The User has the following rights in the processing of its personal data:

Right of perusal
The User has the right to inspect its personal data. Upon request, KMC will provide the User with an overview of the personal data it processes of the User, on what basis, the retention periods, the organizational and technical measures KMC has taken, and whether KMC discloses the User’s information to third parties.

Right to rectification
The User has the right to request KMC to rectify inaccurate or incomplete personal data about the User. If necessary, KMC will rectify the personal data and make it complete.

Right to data erasure
The User has the right to request KMC to erase its personal data. KMC can only do this in the following cases:

  • The personal data are no longer needed for the purposes for which they were originally collected and processed.
  • The User withdraws its consent and KMC has no other legal basis to process the personal data.
  • The User objects to processing and KMC has no legitimate grounds for processing.
  • The personal data has been unlawfully processed by KMC.
  • The personal data must be deleted in order to comply with a legal obligation incumbent on KMC.

Right to restriction
The User has the right to request KMC to restrict the processing of the personal data in any of the following situations:

  • The User disputes the accuracy of the personal data, for a period that allows KMC to verify the accuracy of the personal data.
  • The processing is unlawful and the User opposes the erasure of the personal data and request the restriction of processing instead.
  •  KMC no longer needs the personal data for the purpose of the processing but the User needs the personal data for the establishment, exercise or support of a legal claim.
  • The User has objected to the processing of the personal data and KMC is considering whether its legitimate interests outweigh the User’s legitimate interests.

Right to object
The User has the right to object to the processing of the User’s personal data in any of the following situations:

  • The processing is based on the legitimate interests of KMC.
  • KMC uses the personal data for direct marketing;
  • KMC uses the personal data for statistical or scientific/historical purposes.

KMC may refuse the request if KMC has compelling legitimate interests that outweigh the User’s interests, or if the processing is for the establishment, exercise or support of a legal claim.

Right to data portability
The User has the right to obtain the personal data it has provided to KMC in a structured, common and machine-readable form and to transfer the personal data to another party. Upon request, KMC can transfer the personal data for the User, if this is technically possible. The right to data portability can only be exercised when the following two grounds are met:

  • The processing is based on the User’s consent or the performance of a contract.
  • The processing is carried out through automated processes.

The User has the option to object to the use and processing of its personal data for the purpose of contacting KMS at any time using the contact details provided above. However, KMC would like to point out that in such a case the conversation cannot be continued. All personal data stored in the course of contacting KMCS will be deleted in this case.

The User can submit a request to KMC to exercise one or more of the above rights by sending an e-mail to: info@kmcchain.nl together with contact details, a clear and precise description of the request and, in any case, which right the User wants to exercise and on which grounds.

KMC reserves the right to ask the User to identify itself. In some cases, a reasonable fee may be charged for carrying out the request.

KMC will inform the User within one month about the follow-up given to the request. If it is not possible to comply with the request within one month, KMC will inform the User of this. If it appears that KMC is unable to follow up on the request, it will motivate the rejection to the User.

The User always has the right to file a complaint with the Personal Data Authority if you believe that your privacy rights have been violated.

However, KMC appreciates if the User presents the reason for the complaint to KMC first, so that KMC and the User can reach a solution together.
